2.Nashik Bazzar is Only an E-Platform for communicating Business Offers and Inquiries: Our App acts as the Internet-based platform for users to locate prospective organizations or dealers or end users to trade with. We are not involved in the actual transaction between trading partners. As a result, we have no control over the quality, safety, money transactions or legality of the items being traded, the truth or accuracy of the listed item, the ability of traders to fulfill their obligations in a trade agreement. We cannot and do not control whether or not traders will complete their part of a trade. In the case that there is any dispute between trading partners, Nashik Bazzar, Nashik Muncipal Corporation, Maharashtra Chamber of Commerce Industry & Aggreculture and Ultraliant Infotech Pvt Ltd will be released from any claims, demands, and damages of every kind and nature arising out of or in any way connected to such disputes.

3. "As Is" And "As Available" Basis of Service: You acknowledge and agree that the services are provided on "as is" and "as available" basis. Nashik Bazzar assumes no responsibilities, implied or otherwise, for the timeliness, deletion, mis-delivery, or failure to store any user communications, personalization settings, or service subscriptions.

4. Registration Obligations: When you register with us, you agree to:

1. supply true, accurate, current, and complete information about yourself and your company in the Nashik Bazzar Registration form provided on our App, and
2. Maintain and promptly update your registered information to keep it true, accurate, current, and complete. If you provide any information that is untruthful, inaccurate, not current, or incomplete, Nashik Bazzar has the right to suspend or terminate your registration and refuse any current or future use of the services. If you have registered with us on behalf of a company or other entity, then you represent and warrant that you have the authority to bind such company/shop or other entity to the terms.

5. Member's Username, Password, and Security: During the registration process, you will create username and password. You are responsible for maintaining the confidentiality of your username and password, and for all activities occurring under your username and password. You agree to immediately alert Nashik Bazzar of any unauthorized use of your username and password or any other breach of security. You agree to ensure that you properly exit the web site at the end of each session. Nashik Bazzar cannot and will not be liable for any loss or damage arising from your failure to comply with these terms.

Your Information: 6.1 You agree that your information and the items you offer for trade on Nashik Bazzar -a) will not be fraudulent or involve the sale of counterfeit or stolen items; b) will not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights of publicity or privacy; c) will not violate any law, statute, ordinance or regulation; d) will not be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; e) will not be obscene or child pornography; f) will not contain any viruses, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; g) will not link directly or indirectly to, or include descriptions of goods or services that are prohibited under this agreement; h) will not be in connection with chain letters, junk e-mail, spamming or any duplicative or unsolicited messages; i) will not be used to collect e-mail addresses and other information about other without their consent; and to create false e-mail addresses or otherwise attempt to mislead others as to the identity of the sender or the origin of a message; and j) will be of the sole responsibility of you. This means you, not Nashik Bazzar , are entirely responsible for all content (information, data, text, photographs, and/or graphics) you upload, post, e-mail, or otherwise transmit publicly or privately via our services.

6.2 Items listed are text descriptions, graphics, and/or pictures on Nashik Bazzar supplied by you that either describe an item you have and want to trade, or describe an item you are looking for. You may post either or both of these types of listings on Nashik Bazzar , if you place such offers in an appropriate category. Nashik Bazzar is not responsible for the accuracy or content of listings.

7. License You Grant To Us: You grant to us the exclusive, worldwide, perpetual, royalty-free right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your information (text, pictures, graphics, advertise and promotions), and/or to incorporate your information in other works in any form, media, or technology known or later developed.

8. Privacy: Nashik Bazzar's services are developed to appeal to audience worldwide. Please note that when you voluntarily disclose your information in Nashik Bazzar's trade center and directory, that information can be collected and used by others.

Advertising, Financial, And Logistics Services: You agree that your dealings with or participation with any advertisers or members, whether it is for business or non-business, are solely between you and such parties. Nashik Bazzar should not be responsible or liable for any loss or damage of any sort incurred as the result of any dealings or as the result of the presence of such advertisers on our services.

10. External Links: Our services provide, or third parties may provide, links to other web sites or resources. Since Nashik Bazzar has no control over such sites and resources, you agree that Nashik Bazzar is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible for any content, advertising, products, or other materials on or available from such sites or resources. You further agree that Nashik Bazzar, Nashik Muncipal Corporation, Maharashtra Chamber of Commerce Industry & Aggreculture and Ultraliant Infotech Pvt Ltd shall not be responsible or liable directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods or services on or through any such site or resource.

11. Termination: You agree that Nashik Bazzar, in its sole discretion, may terminate your username, password, and postings, or remove and discard your information within our services, for any reason. If Nashik Bazzar  believes that you have violated or acted inconsistently with the letter and spirit of the agreement.

Causes beyond Control: Nashik Bazzar shall not be liable to you for delays or failures in performing from causes beyond our reasonable control, including, but not limited to, acts of God, labor disputes or disturbances, material shortages or rationing, riots, acts of wars, governmental regulations, communication or utility failures, or casualties.

Agreement to terms of online payment: Nashik Bazzar shall not be liable to you for delays or failures in performing from causes beyond our reasonable control, including, but not limited to, acts of God, labor disputes or disturbances, material shortages or rationing, riots, acts of wars, governmental regulations, communication or utility failures, or casualties.
a) As you or your company/shop chooses to avail services on "as is" and "as available" basis under Paid membership category and pays the subscription amount by online credit card payment system, the service provider for which are "Bank Name", India. It implies to you that your credit card account be deducted with an equivalent amount of Indian currency as applicable and supplied by Nashik Bazzar, on the day of transaction.
b) When you or your company/shop chooses any of the advertisement and promotion programs and services offered by Nashik Bazzar and use of the online credit card payment system for paying the subscription charges for the same, it implies to your agreement that your credit card account be debited with an equivalent amount of Indian currency as applicable and supplied by Nashik Bazzar on the day and date of transaction as per Indian Foreign Exchange rates issued by Reserve Bank of India.
c) Nashik Bazzar have not appointed anyone to collect the fees on behalf of Nashik Bazzar.

14. Refund Policy: : If Nashik Bazzar terminates user(s) membership, user(s) will not have the right to re-enroll or join Nashik Bazzar under a new account or name unless formally invited to do so by Nashik Bazzar. In any case of termination, no membership charges will be refunded, if taken. User(s) acknowledge that inability to use the web site entirely or partially for whatever reason may have adverse effect on its business. User(s) hereby agree that in no event shall the web site be liable to the user(s) or any third parties for any inability to use the web site (whether due to disruption, limited access, changes to or termination of any features on the web site or otherwise), any delays, errors or omissions with respect to any communication or transmission, or any damage (direct, indirect, consequential or otherwise) arising from the use of or inability to use the web site or any of its features.

Nashik Bazzar shall not be responsible for any information/content related to the Medicine(s) and/or Drugs, posted/provided/displayed by the listed Suppliers on our Mobile App– Nashik Bazzar, as we are only a medium of advertisement for the users. Suppliers of the Medicines and/or Drugs hereby undertake that they shall solely be responsible and shall bear all the liabilities in respect of selling prescriptive Medicines and/or Drugs mentioned in the Schedules of the Drugs and Cosmetics Act, 1940, without the Certified Practitioner’s Prescription. In the event of breach of such condition, Nashik Bazzar shall not be liable and responsible in any manner whatsoever, as Nashik Bazzar does not take part in the actual transaction that takes place between the users. User(s) of the Mobile App- Nashik Bazzar undertake and agree to INDEMNIFY and hold harmless Nashik Bazzar or any of its affiliates, directors, officers, employees or representatives from and against any/all losses, liabilities, damages, claims, costs and expenses (including attorney’s fees and expenses, any third party claims), which Nashik Bazzar may incur or suffer as a result of or in connection with any illegal sales of drugs and/or medicines. In compliance with Drug and Cosmetic Act and Rules, we don't display or list the Medicines and/or Drugs mentioned in the Schedule X of the Drugs and Cosmetics Act, 1940. Nashik Bazzar does not offer any guarantees or warranties on the medicinal products or services displayed or listed on our Mobile App– Nashik Bazzar and is not liable for any transaction between users as such, including the sale of any medicine(s) restricted and/or banned for sale by the Governmental or any other Regulatory Authorities.

18. GOVERNING LAW AND DISPUTE RESOLUTIONS :: Terms and condition of use agreement and/ or Agreement, Privacy Policy shall be governed in all respect by the laws of Indian Territory. Nashik Bazzar considers itself and intended to be subject to the jurisdiction only of the Courts of Nashik, Maharashtra, India. The parties to this Agreement hereby submit to the exclusive jurisdiction of the courts of Nashik, Maharashtra, India.

Disclaimer of Warranties: : Nashik Bazzar makes no representations about the accuracy, reliability, completeness, or timeliness of the contents or about the result to be obtained from using the Mobile App and the contents. The use of the Mobile App and the contents is at your own interest and risk.
